United States Limited Warranty

 

THIS LIMITED WARRANTY ONLY APPLIES TO LAWFUL SALES IN THE UNITED STATES OF MOUNTAIN BILLY GUN LAB FIREARMS TO LEGAL RESIDENTS OF THE UNITED STATES.

 

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.

 

THIS LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT WWW.MTNBILLY.COM AND IN THE DOCUMENTATION WE PROVIDE WITH PRODUCTS COVERED BY A WARRANTY.

 

THIS LIMITED WARRANTY ONLY APPLIES TO OWNERS (AS DEFINED BELOW) THAT MEET ALL OF THE FOLLOWING CRITERIA: (I) OWNER IS A RESIDENT OF THE UNITED STATES AND (II) OWNER LEGALLY PURCHASED THE FIREARM IN THE UNITED STATES.

 

THIS LIMITED WARRANTY AND REMEDIES DESCRIBED BELOW ARE EXCLUSIVE AND MADE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

 

THIS LIMITED WARRANTY IS NOT TRANSFERRABLE AND ONLY APPLIES TO THE ORIGINAL RETAIL PURCHASER OF THE FIREARM.

 

This limited warranty is granted by Mountain Billy Gun Lab, LLC (“We” or “Mountain Billy Gun Lab”). This limited warranty is effective from the date of purchase and applies to the original lawful retail purchaser (the “Owner”) of any Mountain Billy Gun Lab firearm (a “Firearm”) (collectively, the “Warranty Period”). With respect to such Firearms, this limited warranty supersedes any and all other warranties.

 

Mountain Billy Gun Lab Firearms are warranted to be free from defects in materials and workmanship during the Warranty Period to the Owner for the lifetime of the Firearm. Upon filing of a warranty claim (see Filing a Warranty Claim below), Mountain Billy Gun Lab will determine if such Firearm and defect is covered under this limited warranty. Once Mountain Billy Gun Lab approves the warranty claim, Mountain Billy Gun Lab will remedy such defect without charge by, and at its sole election, shipping replacement parts to the Owner or repairing the Firearm within a reasonable time after Mountain Billy Gun Lab approves the warrant claim pursuant (see Filing a Warranty Claim below), subject to the terms herein.

UNDER NO CIRCUMSTANCES SHALL MOUNTAIN BILLY GUN LAB BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES WITH RESPECT TO ECONOMIC LOSS, INJURY, DEATH OR PROPERTY DAMAGE, WHETHER AS A RESULT OF BREACH OF THIS WARRANTY, NEGLIGENCE OR OTHERWISE.

 

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Any implied warranties are limited to the life of this limited warranty. All liability and obligations of Mountain Billy Gun Lab are excluded if the instructions in the Mountain Billy Gun Lab Safety and Instruction Manual (as updated from time to time without additional notice) are not followed. The current Mountain Billy Gun Lab Safety and Instruction Manual can be found at www.mtnbilly.com.

 

Mountain Billy Gun Lab’s liability and obligation under this limited warranty is limited to sending replacement parts or repairing a Firearm for a defect in material and workmanship during the Warranty Period for the Owner subject to the terms herein. Whether Mountain Billy Gun Lab sends replacement parts or repairs a Firearm under an approved warranty claim is at Mountain Billy Gun Lab’s sole discretion. Further, Mountain Billy Gun Lab may choose to have a Firearm repaired through a third-party vendor.

 

This limited warranty does not cover and Mountain Billy Gun Lab will not be responsible for:

 

  • Claims, defects, damage, and/or malfunctions resulting from careless handling, failure to follow basic firearm safety practices, or modifications to the product made or attempted by anyone other than a vendor authorized by Mountain Billy Gun Lab for such service.
  • Failure to follow any instructions in the Mountain Billy Gun Lab Firearm’s manuals and instructions (as updated from time to time without additional notice).
  • Use of defective or improper ammunition (including reloaded or remanufactured ammunition), corrosion, neglect, abuse, ordinary wear and tear, or unreasonable use.
  • Claims relating to use in a crime, misuse, negligence, or use under the influence of drugs or alcohol.

 

 

FILING A WARRANTY CLAIM

 

To initiate a warranty claim, please call Mountain Billy Gun Lab customer service at 435-800-5836, Monday – Friday 9:00 A.M. – 5:00 P.M. Eastern Standard Time. Following your call with customer service, please e-mail your warranty claim to customerservice@mtnbilly.com, including the following information:

 

  1. Model and Serial Number of the Firearm;
  2. Description of the difficulty experienced;
  3. Copy of original receipt with retail merchant and date of purchase;

 

 

SHIPPING FIREARMS

 

IMPORTANT: PLEASE DO NOT SHIP FIREARMS WITHOUT A RETURN MERCHANDISE AUTHORIZATION NUMBER FROM MOUNTAIN BILLY GUN LAB. FIREARMS SHIPPED WITHOUT SUCH APPROVAL WILL NOT BE RETURNED. If Mountain Billy Gun Lab approves of a Firearm to be sent in, it is solely the Owner’s responsibility to comply with federal, state, and local laws and regulations when shipping the Firearm to Mountain Billy Gun Lab. The Owner should consult appropriate authorities regarding any restrictive laws in the owner’s jurisdiction regarding shipment and receipt of Firearms. Complete shipping instructions and requirements will be provided after Mountain Billy Gun Lab provides a Return Merchandise Authorization number.

 

 

INFORMAL DISPUTE RESOLUTION

 

The following informal dispute resolution procedure is available to you if you believe that we have not performed our obligations under this limited warranty. You must use this informal procedure before pursuing any legal remedy in the courts. Please e-mail your grievance to customerservice@mtnbilly.com explain in detail your concerns and your desired resolution. Responses will only be given to grievances that have attempted our warranty claim process and were unsatisfied. Mountain Billy Gun Lab will review the grievance and attempt to resolve it in its sole discretion; however, it is not obligated to provide any resolutions beyond the warranty claim process and its determinations therein.
